Terms and Conditions (T&C)

§ 1 Scope of Application

These Terms and Conditions apply to all contracts concluded between

Aviation Sim Design
Dennis Passolt, support@aviationsimdesign.de

and consumers within the meaning of Section 13 of the German Civil Code (BGB) for the sale of digital products (downloads) offered via this website.

§ 2 Subject Matter of the Contract

(1) The subject matter of the contract consists exclusively of digital content, in particular digital add-ons, designs, or files for flight simulators, which are provided to the customer via download.
(2) No physical goods are shipped.

§ 3 Conclusion of Contract

(1) The presentation of products on the website does not constitute a legally binding offer.
(2) By clicking the “Buy Now” button, the customer submits a binding offer to purchase the selected product.
(3) The contract is concluded upon receipt of the order confirmation by email.

§ 4 Prices and Payment Methods

(1) All prices are final prices in accordance with Section 19 of the German VAT Act (UStG) (small business regulation).
(2) The following payment methods are available:

  • PayPal

  • Stripe (Kreditkarte u. a.)

  • Google Pay

  • Apple Pay

  • Klarna

§ 5 Provision of Digital Content

(1) The digital content will be made available for download immediately after receipt of payment.
(2) The customer is responsible for ensuring that the technical requirements necessary for downloading the content are met.

§ 6 Rights of Use

(1) The customer is granted a non-exclusive, non-transferable right to use the digital content for private purposes only.
(2) Any transfer, reproduction, or publication of the files is not permitted unless explicitly authorized.
(3) All copyrights remain with Aviation Sim Design.

§ 7 Right of Withdrawal

Consumers are generally entitled to a right of withdrawal.
Details can be found in the separate withdrawal policy.

§ 8 Liability

(1) We shall be liable for damages only in cases of intent or gross negligence.
(2) We accept no liability for technical problems occurring on the customer’s side.

§ 9 Final Provisions

(1) The law of the Federal Republic of Germany shall apply.
(2) Should any provision of these Terms and Conditions be or become invalid, the remaining provisions shall remain unaffected.

Withdrawal Policy for Digital Products

​

​

Right of Withdrawal

You have the right to withdraw from this contract within 14 days without giving any reason.

The withdrawal period is 14 days from the date of conclusion of the contract.

​

​

Exclusion of the Right of Withdrawal

The right of withdrawal expires if:

  • the contract concerns the supply of digital content,

  • which is not supplied on a tangible medium,

  • the consumer has expressly consented to the performance of the contract beginning before the expiry of the withdrawal period, and

  • the consumer has confirmed that they thereby lose their right of withdrawal.

Consequences of Withdrawal

If you withdraw from this contract, all payments received will be refunded without undue delay, provided that the withdrawal is still effective.
