​​§ 1 Scope of Application

These General Terms and Conditions apply to all contracts between

Aviation Sim Design
Dennis Passolt, support@aviationsimdesign.de

and consumers (§ 13 German Civil Code – BGB) regarding the sale of digital products (downloads) offered via this website.

§ 2 Subject of the Contract

(1) The subject of the contract consists exclusively of digital content, in particular digital add-ons, designs, or files for flight simulators, which are provided to the customer via download.
(2) No physical goods will be shipped.

§ 3 Conclusion of Contract

(1) The presentation of products on the website does not constitute a legally binding offer.
(2) By clicking the “Buy Now” button, the customer submits a binding offer.
(3) The contract is concluded upon receipt of the order confirmation email.

§ 4 Prices and Payment Methods

(1) All prices are final prices in accordance with § 19 German VAT Act (small business regulation – no VAT charged).
(2) The following payment methods are available:

• PayPal

• Stripe (credit card, etc.)

• Google Pay

• Apple Pay

§ 5 Provision of Digital Content

(1) The digital content will be made available for download immediately after receipt of payment.
(2) The customer is responsible for ensuring that the technical requirements for downloading are met.

§ 6 Rights of Use

(1) The customer receives a simple, non-transferable right of use for private purposes only.
(2) Distribution, reproduction, or publication of the files is not permitted unless expressly authorized.
(3) All copyrights remain with Aviation Sim Design.

§ 7 Right of Withdrawal

Consumers are generally entitled to a right of withdrawal.
Details can be found in the separate cancellation policy.

§ 8 Liability

(1) We shall only be liable for damages in cases of intent or gross negligence.
(2) We accept no liability for technical problems on the customer’s side.

§ 9 Final Provisions

(1) The law of the Federal Republic of Germany shall apply.
(2) Should individual provisions be invalid, the remainder of the contract shall remain valid.

Cancellation Policy for Digital Products

​

Right of Withdrawal

You have the right to withdraw from this contract within 14 days without giving any reason.

The withdrawal period is 14 days from the date of conclusion of the contract.

Exclusion of the Right of Withdrawal

The right of withdrawal expires if:

• the contract concerns the delivery of digital content,

• which is not supplied on a tangible medium,

• and the customer has expressly agreed
  that the execution of the contract shall begin before the expiry of the withdrawal period,

• and the customer has confirmed
  that they lose their right of withdrawal by giving such consent.

Consequences of Withdrawal

If you withdraw from this contract, we shall reimburse all payments received without undue delay, provided the withdrawal is still effective.
